Safety & Access Questions - Everything You Need to Know

WHEN IS FALL PROTECTION NEEDED?

Falls are one of the leading causes of workplace injuries and fatalities. Many job sites involve tasks performed at height—such as roof and gutter maintenance, machinery servicing, or loading vehicles—and each of these requires proper fall protection planning.

Fall protection must be considered whenever work is done above ground level or a stable surface. While regulations advise implementing fall protection at heights above 2 metres, it's important to note that any height-related work can carry risk and may still require control measures below that threshold.

WHO IS RESPONSIBLE FOR MANAGING FALL RISKS?

Under the Work Health and Safety (WHS) Act and Regulations, the Person Conducting a Business or Undertaking (PCBU) holds the primary duty of care to ensure that all workers and subcontractors remain safe from fall hazards on site.

The PCBU is responsible for managing fall risks by:

  • Ensuring, where practicable, that hazardous work is done from ground level or solid platforms.
  • Providing safe and secure access to and from elevated work areas.
  • Minimising fall risks through appropriate control measures
  • Making sure all workers are instructed in the correct and safe use of the systems provided.

Workers also have a legal duty to protect themselves and others by following all safety instructions, using equipment correctly, and reporting any hazards or unsafe practices immediately.

Covers the design, installation, and use of anchor points, harnesses, lifelines, and fall arrest systems. Essential for anyone working at height.

Work Health and Safety Acts

The Work Health and Safety (WHS) Acts are the framework for the protection of the health, safety and welfare of all those at work. They outline the broad legal responsibilities of architects, designers, builders, building managers, installers and maintenance workers.

All states (except for Victoria and Western Australia) are covered by the Work Health and Safety (WHS) Act. Victoria is covered by the Occupational Health and Safety (OHS) Act 2004 and Western Australia is covered by the Work Health and Safety Act 2020.

OHS and WHS are not significantly different, the WHS simply provides some additional clarification in some sections. All our products are fully compliant with the more detailed WHS Act to ensure more comprehensive coverage Australia-wide.
